Zoom Mailer Terms of Service
THE FOLLOWING DESCRIBES THE TERMS ON WHICH WE OFFER YOU SERVICES. BY CHECKING THE T&C BOX WHEN YOU CREATE AN ACCOUNT, YOU ACCEPT THE TERMS AND CONDITIONS BELOW. If you do not accept these terms and conditions or have any questions, please contact Customer Support. We may automatically amend these Terms of Service at any time by informing you of the amended terms either when you access your Zoom Mailer account or via e-mail. You accept the amended terms if you access your Zoom Mailer account after such notification. Otherwise, these Terms of Service may not be amended except in a writing signed by both parties.
  1. TERM: The term of service begins at the date of registration.
  2. PAYMENT TERMS: After any FREE services, should you continue to use the service, you agree and promise to pay all applicable fees in advance and is non-refundable.
  3. CANCELLATION POLICY: There is no cancellation policy. Payment is in advance and is non-refundable.
  4. SPAM POLICY: When supplying email lists, you are required to only use the email addresses of people who you have a pre-existing business or personal relationship with you or who have indicated their desire to receive email communications from you ("opt-in"). In addition, you must not prevent a subscriber from automatically removing themselves from your list.
  5. We may add, delete or change some or all of the services provided at any time in our sole discretion.
  6. You shall comply with all laws and regulations applicable to your use of your Zoom Mailer account.
  7. We may terminate your Zoom Mailer account immediately if you breach these Terms of Service or if we are unable to verify or authenticate any information you provide to us. We may also terminate your Zoom Mailer account if we decide, in our sole discretion, to discontinue offering you our services.
  8. WE PROVIDE OUR SERVICES AND YOUR Zoom Mailer ACCOUNT "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights which vary from state to state.
  9. IN NO EVENT SHALL WE BE LIABLE FOR ANY LOST PROFITS OR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH YOUR Zoom Mailer ACCOUNT OR THESE TERMS OF SERVICE. OUR LIABILITY TO YOU OR ANY THIRD PARTIES IS LIMITED TO $50. Some states do not allow the limitation of liability, so the foregoing limitation may not apply to you.
